Soft law e.g. Home Office Concessions and Guidance
Soft Law relates to guidance provided by the Home Office which assists in the interpretation of both Asylum and Immigration Statutes, Statutory Instruments and Regulations. This guidance is contained within the Immigration Nationality Directorate Website. Soft Law also relates to Home Office Concessions such as the rule concerning children who have resided in the UK for more than seven years and the current ‘one off’ Home Office exercise in which asylum seekers with dependants who brought a claim prior to October 2000 may be eligible to apply for Indefinite Leave to Remain in the UK.

This gives guidance on how NASS should treat applications for support from unaccompanied minor asylum seekers who are approaching 18 and are being supported by the local authority. There has been litigation around the Leaving Care Act in England.
