Legal Section
The legal section has been divided into three sections.
A brief introduction to each section is provided below.
The Asylum Procedure section provides information on the asylum process. Following an introduction to the immigration and asylum law, details are provided on how an individual applies for asylum, the various stages of consideration of the claim leading on to the final decision, appeals rights and the process through the Immigration Appeal Courts and the Court of Session.
The Status Rights and Issues section provides information on rights of individuals whilst their application is being considered. Other issues included in this section are on Female Genital Mutilation (FGM) and adoption and fostering rights.
The Legislative Framework provides links to various Acts of legislation including both domestic and international law relevant to the consideration of an asylum claim and grant of refugee status. In addition to legislation information on policies, guidelines and European directives are also included in this section.
