Needs Arising Solely Because of Destitution or its Physical Effects
An important source for the duty on a local authority to provide a safety net for people facing destitution is found in ss 12 and 12A of the Social Work (Scotland) Act 1968 (SWSA). these provisions oblige every local authority to 'promote social welfare by making available advice guidance and assistance…and in that behalf to provide or secure the provision of such facilities as they may consider suitable and adequate and such assistance may, subject to other statutory provisions be given in kind or in cash'.
However, SWSA s 12(2A) says that asylum seekers (and other specified people who are subject to immigration control) are not to receive assistance under SWSA s 12 'if his need for assistance has arisen solely (a) because he is destitute; or (b) because of the physical effects, or anticipated physical effects, of his being destitute.'
