Challenges to Section 55

In England, a large number of asylum seekers who had been refused support under s 55 applied for judicial review. Following other successful challenges ((Q) v Secretary of State for the Home Department [2003] EWCA Civ 364, [2004] QB 36) in May 2004 the English Court of Appeal held that the denial of shelter to asylum seekers was a denial of their human rights: R (on the application of Limbuela and others) v Secretary of State for the Home Department [2004] All ER (D) 323 (May), [2004] EWCA Civ 540.
