The Decision-making Process
Home Office officials in the Immigration and Nationality Directorate make decisions about applications for asylum, usually based on an interview conducted through an interpreter, and submissions made on a Statement of Evidence form. Port applicants are frequently interviewed about their claim soon after arrival and may not be issued with a Statement of Evidence form to complete. Applications from people who have travelled through safe third countries , or from people who come from safe countries of origin may be fast tracked or in some cases not given substantive consideration. If this is the case, then the full decision making procedure will not apply to them. Fast track processes are in use at the Oakington detention centre, in England. People dispersed to Scotland may still be transferred to Oakington. It is vital that applicants in this situation get expert legal advice.
